A Jonesboro woman is suing a man and two Marissa bars alleging negligence in a 2014 accident.
Samantha Smith of New Athens brought suit against William Welmon of Madison County, as well as Em’s Tavern and Pourhouse Bar & Grill on March 3 in St. Clair County Circuit Court.
Smith was a passenger in Welmon’s car on or about April 18, 2014. As the defendant was driving northbound on Illinois Route 4, his car left the roadway, struck a sign and overturned several times, according to the suit.
The plaintiff claims Welmon failed to reduce speed to avoid an accident, failed to maintain a proper lookout, failed to keep his vehicle in the proper lane of travel, and failed to exercise reasonable care in driving.
Smith claims she suffered injuries to her face and jaw that required surgery and extensive medical bills.
She cites both taverns with violation of the Dramshop Act for allegedly allowing Welmon to become intoxicated by over-serving him alcoholic beverages.
Seeking damages in excess of $50,000, plus attorneys’ fees and costs, Smith is represented in the case by Justin Kuehn of Kuehn, Beasley & Young of Belleville.
