A Union Pacific Railroad engineer is suing over injuries he claims happened two months ago while working near Bismarck, Mo.
Larry Maupin of Cahokia filed suit Feb. 13 in St. Clair County Circuit Court.
Maupin claims that on Jan. 1 while conducting work as a locomotive engineer, slack action on the train ran into the engine, "causing Plaintiff to be knocked over and down the interior of the stairs of the lead locomotive."
He claims he suffered brain, head, neck, shoulder and other injuries as a result of his employer's alleged negligence.
Among other things, he claims the railroad failed to provide safe methods for work in that the engine failed to include a trailing distributive unit to control slack action, and that the defendant's fuel conservation policies and procedures prohibited him from being able to utilize reasonably safe and industry standard train handling techniques for controlling slack action.
Maupin seeks damages in excess of $50,000 under the Federal Employers Liability Act.
