Attorney claims buyers breached contract involving sale of Alton property

Edwardsville asbestos attorney Barry Julian is suing a couple and their business saying they have failed to make payments in accordance with a promissory note for property purchased in Alton.

Julian filed the suit Aug. 28 in Madison County Circuit Court, naming Aaron and Sarah Hutson and Hutson and Associates, an engineering and land surveying business.

The suit claims the parties entered into a contract for sale of the property located at 3555 College Ave. in Alton on March 9, 2009. Under the terms of the note, the defendants promised to pay $100,000 plus 7.5 percent interest per annum on the part of the outstanding principal and interest that was not paid, the suit claims.

Julian claims the defendants agreed to pay $2,043.87 per month beginning in April 2009.

He alleges the defendants have breached contract and still owe $42,840.04 in principal, as well as interest. He further claims they have only made one payment since Nov. 16, 2012.

Julian is represented by Gail Renshaw of Julian and Associates in Edwardsville.
