Driver accused of striking stopped vehicle in Collinsville

A woman has filed suit against the driver she claims rear-ended her vehicle while she was stopped at a red light.

Cecilia Gutierrez filed suit Aug. 21 in the Madison County Circuit Court against Blake Richter.

According to the complaint, the plaintiff was stopped at a red light at the intersection of Bluff Road and Collinsville Road on Sept. 27, when defendant Richter, who was driving a 2009 Pontiac Vibe, struck the back of her vehicle.

Due to the collision, Gutierrez claims she suffered head, neck and upper back injuries, experienced pain and limited function and incurred medical costs, according to the complaint.

Richter negligently drove too fast, following Gutierrez's vehicle too closely, failed to properly maintain control of his vehicle, failed to keep a vigilant lookout, failed to sound his horn and failed to safely stop behind Gutierrez's vehicle, the suit states.

Gutierrez is seeking a judgment of more than $50,000, plus costs and other relief the court deems just. She is being represented by attorney Gonzalo Fernandez of Devereaux, Stokes, Nolan, Fernandez and Leonard in St. Louis.
