Route 40 rear-end crash leads to suit

A man and his wife say the man sustained significant pain and suffering after a driver rear-ended their vehicle.

Timothy and Rhonda Rosenthal filed a lawsuit Aug. 22 in the Madison County Circuit Court against Elizabeth Vermillion.

In their complaint, the Rosenthals say Timothy Rosenthal drove north on Illinois State Highway 40 near Amberwood Drive in Madison County on Feb. 13, when he stopped to make a left-hand turn. Suddenly, Vermillion, who was also driving north, stuck the back of his vehicle.

Due to the collision, Timothy Rosenthal suffered permanent pain, lost his enjoyment of life and incurred disfigurement, according to the complaint. He also lost wages and incurred medical costs while his wife was permanently damaged and lost her husband's love, companionship and society, the suit states.

In their complaint, the Rosenthals blame Vermillion for causing the collision, saying she negligently failed to keep a proper lookout, failed to keep her vehicle under proper control and failed to reduce her speed to avoid a collision.

The Rosenthals seek a judgment of more than $150,000, plus costs. They are being represented by attorney Eric Kirkpatrick of Kirkpatrick Law Offices in Belleville.
