Bus agency to argue motion to dismiss passenger's injury suit

Circuit Judge Barbara Crowder on April 25 will hear defendant Madison County Mass Transit District’s motion to dismiss a lawsuit filed by a passenger claiming injuries.

Michael Delany sued the agency last July, claiming he sustained permanent injuries when a bus driver struck a vehicle.

Delany says he was riding on a bus defendant Danny Hillis was operating on July 19, 2012. The bus was traveling on Canal Street and Route 3 in Brooklyn when it struck the left rear panel of another vehicle, according to the complaint.

Delany blames Hillis and the agency for causing his injuries, saying they negligently failed to keep the bus under proper control and failed to keep a proper lookout.

In his complaint, Delany is seeking a judgment of more than $300,000, plus costs.

Thomas Q. Keefe Jr. of Keefe and Keefe in Belleville represents Delany.

Donald J. Ohl of Knapp, Ohl and Green in Edwardsville represents Madison County Mass Transit District.
