Father sues driver for car collision that led to son's death

A father is suing a driver for allegedly causing a car accident that ultimately led to his son's death.

William Kroll, father of Thomas Kroll and the administrator of his estate, filed a lawsuit on June 8 in Madison County Circuit Court against Claude Burney, citing vehicular negligence.

According to the suit, during the late afternoon of June 27, 2013, Thomas Kroll was driving a Saturn Ion northbound on Grangehall in the city of Ruyle when Burney, driving a 1997 Chevy S10 in a westerly direction on State Highway 16 near its intersection with Grangehall, disobeyed a stop sign and collided with Thomas Kroll's vehicle.

The plaintiff alleges Burney failed to safety operate his vehicle, drive at an appropriate speed, apply brakes and keep a proper lookout.

The suit states that Thomas Kroll died as a result of the accident which has caused his family immeasurable grief and economic loss, as well as loss of society, love and companionship.

The plaintiff seeks damages in excess of $50,000, plus the costs of suit. The plaintiff is also suing Children's Home and Aid Society of Illinois, of which Thomas Kroll was a employee of, for the same amount as it is vicarious liable for the damages endured by the surviving next of kin of Thomas Kroll.

The plaintiff is represented by Lanny Darr of Darr Firm in Alton.
