Pedestrian files personal injury suit over pothole fall

A St. Clair County resident claims she suffered permanent injuries when she fell in a pothole.

Nakia Price filed a lawsuit in St. Clair County Circuit Court on May 21 against Willie McIntosh and Lady Nan Inc. of East St. Louis, alleging negligence.

According to the complaint, the plaintiff was on the defendant’s premises at 3793 St. Clair Avenue in East St. Louis on Sept. 8, 2013. The suit states that the parking lot contained an irregular and uneven walking surface, including potholes.

Alleging the parking lot’s surface condition created a tripping hazard for pedestrians, the plaintiff claims she fell in a pothole and sustained severe injuries.

The plaintiff claims the defendant should have known about and addressed the parking lot's hazardous condition, the suit states. She accuses the defendant of breach of duty and premises negligence. The plaintiff cites the defendant for poor lighting, inadequate inspection and repair, failure to erect a protective barricade around dangerous areas and neglecting to warn the plaintiff.

The plaintiff claims to have suffered severe and permanent injuries to her knees and ankles, medical expenses, lost earning capacity, physical and mental pain and suffering, and lost enjoyment of life.

Price seeks damages in excess of $50,000, plus attorney’s fees and costs. She is represented by Jeffrey Kopis of Kopis Law Office in Belleville.
