A class action lawsuit has been filed against Bob Evans Restaurants, LLC, alleging that the company failed to properly compensate its employees for overtime work.

The lead plaintiff in the case, Rufus Mitchell, claims that he and other similarly situated workers were misclassified as exempt from overtime pay under both federal and Illinois state laws.

This misclassification allegedly led to employees working more than 40 hours per week without receiving the required overtime wages.

The lawsuit seeks to recover unpaid wages, penalties, and damages for all affected employees over the past three years.

Plaintiffs are represented by attorney Don J. Foty, of Hodges & Foty, of Houston.

The lawsuit was filed in the U.S. District Court for the Southern District of Illinois.
