Charles R. Carnahan sues Brinda F. Stepping for property dispute

In the Appellate Court of Illinois, Fifth District, Charles R. Carnahan has filed a lawsuit against Brinda F. Stepping and Tracy L. Aranico, case ID 20-CH-261, dated April 17, 2024. The case pertains to a property dispute where Carnahan claims ownership of the disputed land and accuses the defendants of trespassing.

Carnahan filed a complaint for trespass against Stepping and Aranico on September 1, 2020. In response, Aranico filed a counterpetition for ejectment based on adverse possession on June 17, 2021. The trial court ruled in favor of Carnahan on January 18, 2023, stating that he was the rightful owner of the disputed property and that the defendants failed to establish adverse possession.

However, the court made an error by ordering damages when this issue had been reserved for further hearing by agreement of all parties involved and the trial court itself. Therefore, part of the judgment was vacated.

Carnahan is seeking affirmation of his ownership rights over the disputed property and wishes for Stepping and Aranico to cease their alleged trespassing activities. He also seeks damages for any harm caused due to these actions.
