Gregory Clark sues American Legion Post 365 for race-based discrimination and retaliation

Gregory Clark has filed a lawsuit against American Legion Post 365 in the United States District Court, Southern District of Illinois, East St. Louis Division. The case, identified as 3:24-cv-00970, was filed on March 28, 2024. The suit alleges race-based discrimination and retaliation under Title VII of the Civil Rights Act of 1964.

Clark was employed by American Legion Post 365 as a Building Maintenance worker from April 2022 until his termination on November 15, 2023. The plaintiff alleges that he was subjected to different terms and conditions of employment than others not within his protected class and that he suffered adverse employment actions due to his race.

The complaint further details an incident in August 2023 where Clark reported offensive comments and racial slurs made by a coworker, Robert Dawtrey. Following this complaint, Clark claims he experienced disparate treatment and retaliation including reduced work hours and baseless accusations from Commander Jesse (LNU).

Clark is seeking redress for the alleged race-based discrimination and retaliation under Title VII of the Civil Rights Act of 1964. He asserts that all conditions precedent to jurisdiction have been complied with including filing a charge of discrimination with the Equal Employment Opportunity Commission (EEOC) and receiving a Notice of Right to Sue.
