Derick Derbas sues Jackson County Sheriff’s Office for violation of constitutional rights and negligence

Derick Derbas, represented by Hale & Monico, has filed a lawsuit against Jackson County Sheriff’s Office, Jackson County, Williamson County Sheriff’s Office, Williamson County, and currently unknown employees of both sheriff's offices. The case was filed in the United States District Court for the Southern District of Illinois under the case ID 3:24-cv-01060-JPG on April 8th, 2024. The complaint alleges violation of Derbas' constitutional rights and seeks redress under the Civil Rights Act and Illinois state law.

The plaintiff, Derick Derbas, is a resident of Illinois who was detained at Jackson County Jail in March 2023. He alleges that he experienced severe groin pain while in custody but was denied immediate medical attention by an unknown employee of the Jackson County Sheriff's Office. On March 20th, 2023, Derbas was allowed to see a nurse employed by the same office where he reported severe pain and symptoms including blood in his urine.

The lawsuit further claims that despite his condition worsening over time and repeated requests for medical help, Derbas did not receive adequate medical care from either Jackson or Williamson county jails. His lawyers argue that this negligence resulted in unnecessary suffering and violated his constitutional rights under the Fourth and Fourteenth Amendments.

Derbas is seeking an unspecified amount in damages for physical pain and emotional distress caused by alleged neglect from jail staff. His attorneys are also invoking jurisdiction under Title 28 of the United States Code Sections 1331 and 1343.
