Juan Reyes sues Randy Brinegar for denial of motion for subpoenas and reconsideration

Juan Reyes has filed an appeal against Randy Brinegar in the Appellate Court of Illinois, Fifth District. The case, numbered 15-MR-421, was originally heard in the Circuit Court of Vermilion County and was presided over by Judge Karen E. Wall. The appeal was filed on April 5, 2024.

Reyes, acting as a pro se appellant, contests the circuit court's denial of his motion for subpoenas and his request for reconsideration of the dismissal of his "complaint for declaratory relief". He also alleges that the court lost jurisdiction over this case due to the expiration of 30 days after the entry of a final judgment without the timely filing of a postjudgment motion. On the other hand, Brinegar, who is the erstwhile State’s Attorney of Vermilion County, has not filed an appellee’s brief.

The plaintiff is seeking a remand to the circuit court with directions that untimely motions filed by him be stricken off. This stems from Reyes' criminal conviction in 2007 for home invasion and first-degree murder among other charges where he was sentenced to life imprisonment.
