EDWARDSVILLE - A wrongful death lawsuit alleges a driver suffered fatal injuries in a head-on collision while attempting to turn on US 40.
The lawsuit was filed in the Madison County Circuit Court by plaintiff Angela Jones, as special administrator of the estate of Braunnika Marble, deceased, Nicholas Maple, Gale Lee, as mother and next friend of minor Chasity Lee, and Gabriel Lee, against Katie Jernigan.
According to the complaint, Braunnika Marble was operating a vehicle and attempting to turn on US 40 when Jernigan allegedly failed to yield the right-of-way and caused a head-on collision.
The plaintiffs allege Jernigan failed to exercise the highest degree of care, failed to operate her vehicle at a speed that would permit her to stop within the assured clear distance ahead, failed to keep a proper lookout and take necessary action despite knowing there was a reasonable likelihood of a collision.
As a result of these alleged failures, Breaunnika Marble died from injuries sustained in the crash.
The plaintiffs are seeking damages in excess of $50,000 for various injuries and losses including grief, sorrow, mental anguish over Marble's death, medical expenses and loss of body function. They are represented by attorney Eric Wolfgram of Wolfgram Law.
