Wrongful death suit alleges nursing home patient died after falling

BELLEVILLE - The daughter of a nursing home patient who died after suffering multiple falls claims her mother received negligent care.

The lawsuit was filed in the St. Clair County Circuit Court by Karyn Eisemann, on behalf of the late Kathryn Eisemann, against Aperion Care of Mascoutah, LLC and Bria of Mascoutah, LLC. Karyn Eisemann is Kathryn's surviving daughter and the special administrator of her estate.

According to the complaint, Kathryn was admitted to the defendants' nursing home in March 2019 and was identified as a fall risk. Then on Dec. 6 and 11, 2021, she fell from her wheelchair and bed while under the defendants' care. The falls allegedly resulted in severe injuries to her femur and humerus. 

Kathryn was hospitalized for treatment from Dec. 11 until her death on Dec. 17, 2021. Her daughter alleges the defendants were negligent in their duty of care towards the decedent, resulting in her death. 

The plaintiff seeks a judgment in excess of $50,000, plus court costs. She is represented by Gregory Klote of Halvorsen Klote.
