Legal malpractice claim alleges collision suit was not timely filed

EDWARDSVILLE - A man alleges his lawyer failed to timely file a lawsuit after he crashed due to items falling off the vehicle in front of him. 

The lawsuit was filed in the Madison County Circuit Court by motorist Benjamin Broadnax against Anthony Gray and law firm Johnson Gray, LLC. 

According to the complaint, Broadnax claims he was driving on Sept. 25, 2020, when the vehicle in front of him failed to secure its load. As a result, items fell off the vehicle and into the roadway, causing a collision with the plaintiff. Broadnax claims he suffered injuries and lost wages as a result of the crash.

Broadnax claims he hired Gray to represent him in his claim for damages against the alleged at-fault party in the crash - RPKG Holdings LLC, doing business as Firecreek Snacks. Broadnax claims Gray failed to file the lawsuit before Sept. 26, 2022, under the statute of limitations. 

The plaintiff is seeking judgment against both defendants for an amount greater than $50,000, plus all other relief the court deems just. He is represented by Jeremy Gogel of The Gogel Law Firm.
