Home buyer alleges fraud scheme after receiving eviction notice despite making payments

EDWARDSVILLE - A home buyer claims she was served an eviction notice despite making payments on the property due to an alleged fraudulent scheme.

The lawsuit was filed in the Madison County Circuit Court by plaintiff Ashley Deckard against defendants Cynthia Shriver, Pautschtech LLC, doing business as Win-Win Solutions Trust, and Red Bird Country Trust. The complaint alleges that the defendants orchestrated an illegal scheme involving fraudulent home sales through deceptive means.

According to the complaint, Deckard claims she entered into an installment sales contract with the defendants on Jan. 13, 2023, for a residence priced at $135,000. She paid a down payment of $13,500, representing 10% of the total purchase price. Since then, she has made payments amounting to 20% or more of the purchase price, the suit states.

However, Deckard alleges Shriver individually filed an eviction complaint against her in December 2023 for allegedly not fulfilling the agreed-upon contract terms. Deckard asserts that this is part of an unlawful scheme conducted by the defendants.

The case invokes provisions from the Illinois Installment Sales Contract Act and the Consumer Fraud and Deceptive Business Practices Act. 

Deckard seeks compensation for both economic and non-economic damages resulting from the defendants' alleged acts. The plaintiff is represented by attorney Jaye Lindsay of Crossroad Legal.
