Nursing homes sued over resident's death

EDWARDSVILLE - Several nursing facilities are being sued after a resident allegedly died due to negligent care.

The lawsuit was filed in the Madison County Circuit Court by Melody Kerbs, on behalf of decedent Keith Zumwalt, against BRIA of Godfrey LLC, Aspen Creek Management Inc., and Vitas Healthcare Corporation of Illinois.

According to the complaint, Kerbs is the daughter of Zumwalt. The decedent was a resident at BRIA from Nov. 19, 2021, to Dec. 15, 2021. He was then transferred to Aspen for specialized memory care and rehabilitation. The suit states that during his stay at both facilities, Zumwalt allegedly suffered from pressure ulcer wounds. 

Zumwalt was transferred to St. Elizabeth's Hospital on Jan. 17, 2022, for treatment but was discharged back to Aspen on Jan. 21, 2022. 

The suit states that Zumwalt succumbed to his injuries and died on Feb. 10, 2022. The plaintiff alleges the defendants failed in their duty of care towards Zumwalt prior to his death.

Kerbs demands a trial by jury and seeks a judgment in her favor. She is represented by attorney Craig Jensen of MeyerJensen P.C.
