Forklift operator alleges wrongful termination over alleged medical disability

EDWARDSVILLE - A forklift operator for Saddle Creek Logistics claims he was not provided appropriate accommodations for a medical disability. 

The lawsuit was filed in the Madison County Circuit Court by David W. Liticker against his former employer, Saddle Creek Corporation, also known as Saddle Creek Logistics Services. Liticker accuses Saddle Creek Corporation of unlawful discrimination under the Illinois Human Rights Act.

Liticker alleges he was discriminated against due to his disability. He suffers from bilateral plantar fasciitis and bilateral inflammation and derangement of the soft tissues of his feet, which he claims significantly impair his physical ability to walk, stand, work and perform other activities of everyday living. Despite these impairments, Liticker claims he was able to perform essential elements of his job with or without reasonable accommodations.

The plaintiff claims that instead of seeking a reasonable accommodation for his disability, the defendant dismissed him in 2022, causing him inconvenience and loss of pay and employment benefits.

Before filing this lawsuit, Liticker had filed a charge of discrimination with the Illinois Department of Human Rights (IDHR). However, IDHR dismissed the charge citing lack of substantial evidence. Liticker is now seeking judgment in his favor through the court system.
