The estate of a deceased railroad employee alleges he developed laryngeal cancer due to exposure to toxins
The lawsuit was filed in the Madison County Circuit Court by plaintiff Laura Jordan, individually and as the independent executor of the estate of Charles Boggess, who died from laryngeal cancer in 2021. The suit was filed against defendants Whirlpool Corporation, individually and as a successor-in-interest to Maytag Corporation, and Chicago Pacific Corporation.
The plaintiff alleges that during Boggess's employment with the defendant from 1965 to 1979, he was exposed to toxic substances, including diesel exhaust fumes, silica, and second-hand asbestos. The suit states that this exposure led to Boggess developing laryngeal cancer.
According to the complaint, the defendant failed to provide a safe working environment, adequate tools and equipment, warnings about the hazardous effects of toxic substances, and did not take sufficient care for the health and safety of its employees.
The plaintiff is seeking damages exceeding the jurisdictional limit of the court for Boggess's cancer diagnosis and subsequent death. She is represented by Ted Gianaris of Gianaris Trial Lawyers in Alton.
