Madison County homeowners claim construction companies failed to adequately repair their home following substantial fire damage in May 2019.
Homeowners Kelly and Leah Gregory filed the lawsuit in the Madison County Circuit Court against McCullough's Flooring Enterprise Inc. and Middendorf & Reuss Construction Inc.
The Gregorys claim they hired Middendorf & Reuss Construction (MRC) based on their reputation as a well-qualified remodeling/rebuilding contractor. They agreed to pay $406,703.25 for the services, which included subcontracted flooring work by McCullough’s Flooring Enterprise (MFE). However, the plaintiffs allege MRC breached the contract by failing to ensure that the flooring was installed correctly and in accordance with industry standards. They also claim MRC did not install a moisture or vapor barrier and failed to ensure that their basement was adequately waterproofed.
The Gregorys are seeking damages of at least $50,000, all penalties allowed by law, and any further relief deemed just by the court. They are represented by Angie Zinzilieta of Wendler & Zinzilieta PC in Maryville.
