EDWARDSVILLE – Xpert Xteriors, a Glen Carbon-based construction company, has filed a lawsuit claiming an individual fraudulently pretended to be an agent of the company to procure construction jobs.
Plaintiff Reeves Exteriors, Inc., doing business as Xpert Xteriors filed the lawsuit in the Madison County Circuit Court against Brandon A. Calvert, citing fraud and unjust enrichment.
According to the lawsuit, Xpert Xteriors was in communication with Calvert regarding his possible employment with the company in 2022. Xpert alleges that Calvert actually had no intention of working for the company. The plaintiff alleges that while being considered for the position, Calvert learned of the company's operating methods, construction services offered, and methods of customer outreach.
Xpert alleges that after gathering this information, Calvert created signs advertising himself as an agent of the company and began performing numerous construction projects while misrepresenting himself as an employee of the company. According to the lawsuit, Calvert never informed Xpert of the projects, never compensated them out of any of the proceeds of his work, and sometimes failed to properly complete projects while misrepresenting himself as an employee of the company, causing customers to contact Xpert to complain about his work. Xpert states that to protect the company's good name, it was forced to remediate and complete some of the projects Calvert failed to properly complete.
The plaintiff is demanding a trial to seek damages in excess of $50,000, plus interest, attorneys fees, court costs, and any other relief the court deems proper. In addition the plaintiff is requesting that the court issue a permanent injunction prohibiting Calvert from using the company name and promotional materials.
