Patient alleges defective port catheter caused her injuries

EAST ST. LOUIS - An Edwardsville woman is suing medical device companies, claiming a defective port-catheter caused her injuries and had to be surgically removed. 

Alberta Wilson filed a lawsuit in the U.S. District Court for the Southern District of Illinois against Becton, Dickinson and Company, C.R. Bard, Inc., Bard Access Systems, Inc. and Does 1 through 10, citing fraudulent concealment and negligence.

According to the lawsuit, the defendants are medical technology companies that develop, manufacture and market medical devices. Wilson alleges that on June 24, 2009, she had a port-catheter device implanted in her body that was manufactured and sold by the defendants. Wilson alleges that complications arose from the defective device. She claims that on Oct. 7, 2009, she had to undergo surgery to remove the device.

The lawsuit states that the device has had numerous reports documenting severe complications and injuries and that such claims were reported to the defendants. Despite this knowledge, the defendants continued to promote and sell the device while allegedly claiming that these failures were caused by factors other than the device's design and composition, the suit states. 

According to the lawsuit, the defendants were negligent in their design, manufacture, marketing and distribution of a defective and dangerous medical device and failure to provide proper warning of the risks of the device.

Wilson claims that as a result, she suffered injuries and was forced to undergo surgery. She alleges her injuries have caused her to experience physical, mental and emotional damages. 

Wilson is seeking compensatory damages, punitive damages, interest, attorney's fees, court costs and any other relief the court deems proper. She is represented in this case by attorney Aaron K. Dickey of Dickey Anderson Law Firm in St. Louis.
