Motorist sues following rear end collision near construction zone

BELLEVILLE – A driver filed a negligence lawsuit against Keeley & Sons following a rear end collision near a construction site, claiming that the company did not have proper warnings in place.

Plaintiff Kristopher Plocher filed the lawsuit in the St. Clair County Circuit Court against Keeley & Sons, Inc. and Blake Bailey, citing negligence. 

According to the lawsuit, on June 16, 2021, Plocher was driving southbound on Illinois Route 159 near an area where Keeley & Sons was performing construction work. The lawsuit states that Keeley & Sons had created an unreasonably dangerous condition by posting an employee holding a stop sign on a hill which provided limited visibility to motorists. 

Plocher alleges Keeley & Sons was negligent in failing to provide proper and adequate warning to motorists to reduce their speed in the presence of construction zone and construction workers. As a result, Plocher had to stop suddenly and was rear ended by Bailey. Plocher adds that Bailey was negligent in following his vehicle in a manner that would fail to allow him to avoid a collision.  

The lawsuit states that as a result of the defendants' negligence, Plocher has sustained severe bodily injuries which have caused him to experience frequent headaches, pain, suffering, and lost wages. The lawsuit adds that Plocher has incurred medical expenses and will continue to require the services of medical staff to recover.

Plocher is seeking damages in excess of $50,000 and any other relief the court deems proper. He is represented in this case by attorney Thomas E. Fagan of Conquer Law, LLC in St. Louis.
