Suit alleges Metro bus stop collapsed on top of passenger

BELLEVILLE – A MetroBus passenger has filed a negligence lawsuit after a bus stop shelter allegedly collapsed on top of him.

Plaintiff Johnny Fulton filed the lawsuit in the St. Clair County Circuit Court against Bi-State Development Agency, doing business as Metro, and The Bi-State Development Agency of the Missouri-Illinois Metropolitan District, doing business as Metro, citing negligence.

According to the lawsuit, Fulton was waiting for a MetroBus at the Metro bus stop shelter at the Jackie Joyner-Kersee Center Metro Station in East St. Louis on May 30, 2022. He alleges he came into contact with the plexiglass wall of the structure which had somehow become loose and unsecured, causing the structure to collapse on top of him. 

According to Fulton, the defendants are responsible for the maintenance and upkeep of the bus stop, and they negligently failed to properly maintain the structure to protect the safety of its patrons. 

Fulton claims he sustained serious bodily injuries, which have caused him to experience pain, suffering, mental anguish and disability. He adds that his injuries will affect his ability to enjoy normal activities and earn income in the future. He further states that he has incurred medical expenses and will continue to require the services of medical staff to recover from his injuries.

The plaintiff is seeking damages in excess of $50,000, plus court costs and any other relief the court deems proper. He is represented in this case by attorney Steven E. Katzman of Katzman & Sugden, LLC in Belleville.
