BRIA of Cahokia patient alleges fall caused internal bleeding

BELLEVILLE – A patient at BRIA of Cahokia filed a negligence suit claiming he fell and injured himself while in their care.

Plaintiff Roy Johnson filed a lawsuit in the St. Clair County Circuit Court against Atrium Health Care & Rehabilitation Center of Cahokia, doing business as BRIA of Cahokia, citing negligence in violation of the state's Nursing Home Care Act.

According to the lawsuit, Johnson was a patient in the care of BRIA of Belleville and was transferred to BRIA of Cahokia on Aug. 10, 2022, after he experienced a fall at the previous facility. Upon admission, Johnson was evaluated as being at high risk for falls. 

Despite the evaluation, the lawsuit alleges that Johnson fell and injured himself while in the facility's care during an incident that wasn't documented. On Sept. 2, Johnson was allegedly experiencing cognitive changes and was sent to the ER. A CT scan revealed that Johnson was suffering from bleeding inside his head, which required him to undergo emergency surgery. 

According to the lawsuit, the defendant negligently failed to provide proper care to protect Johnson from injury. The lawsuit states that as Johnson was admitted into the defendants' care, he was a protected individual under the state's Nursing Home Act. 

Johnson states that as a result of his injury, he has experienced disability, pain, and suffering. He alleges his injuries will impact his ability to lead a normal life. He adds that he has incurred medical expenses and will continue to require the services of medical staff to recover from his injuries.

The plaintiff is seeking damages in excess of $50,000, plus attorney's fees, court costs and other relief the court deems proper. He is represented in this case by attorney Alex Campos of Dudley & Lake, LLC in Chicago.
