Suit alleges woman tripped, fell at O'Fallon American Legion

BELLEVILLE – A man is suing the American Legion in O'Fallon after his wife allegedly fell and injured herself on the sidewalk as it was in disrepair.

Plaintiff Todd Hill filed the lawsuit in the St. Clair County Circuit Court against Fischer-Sollis Post 137 O'Fallon American Legion, Swift Plumbing & Home and LW Contractors, Inc., citing negligence.

According to the lawsuit, Hill's wife, Ginger Zehner, was a visitor at the O'Fallon American Legion on April 16, 2021. While she was on the premises, she tripped and fell on the sidewalk, which was allegedly in a state of disrepair. The lawsuit states that the American Legion had entered into an agreement with contractors Swift Plumbing & Home and LW Contractors to perform construction work on the premises. The work allegedly required that the section of the sidewalk had to be torn out. 

According to Hill, the defendants negligently failed to protect the safety of visitors by failing to provide proper warnings regarding the unsafe condition. 

The lawsuit states that Zehner has suffered severe injuries to her hip. Hill is seeking damages for the loss of his wife's consortium and support. 

The plaintiff is seeking damages in excess of $75,000, plus court costs, interest and any other relief the court deems proper. He is represented in this case by attorney Eric M. Rhein in Belleville.
