EDWARDSVILLE – A Union Pacific Railroad Company employee has filed a lawsuit claiming that he was injured on the job due to negligence.
Plaintiff David A. Link filed the lawsuit in the Madison County Circuit Court against defendant Union Pacific Railroad Company, citing negligence in violation of the Federal Employers' Liability Act.
According to the lawsuit, Link was employed by Union Pacific Railroad Company as a machine operator. The plaintiff states that during the course of his employment, he suffered "numerous repetitive traumas."
Link claims the defendant failed to provide him suitable tools, equipment and supervision to do his assigned tasks safely.
The plaintiff alleges he has sustained severe and permanent injuries, which have caused him to experience pain, suffering, mental anguish, disability, and lost wages. He alleges his injuries will affect his ability to earn income and enjoy daily life. He adds that he has incurred medical costs and will continue to require the services of medical staff to recover.
The plaintiff is seeking damages in excess of $50,000, plus court costs and any other relief the court deems proper. He is represented in this case by attorney Benjamin P. Tobin of Pratt & Tobin in East Alton.
