Bagley Farms Meat Market sues over alleged defective refrigeration unit

EDWARDSVILLE – Bagley Farms Meat Market claims it received a defective refrigeration unit. 

Bagley Farms Meat Market, LLC filed the lawsuit in the Madison County Circuit Court against Ford Hotel Supply Company, Inc. and Tawk Mechanical Penguin Services, Inc. citing breach of warranty and negligence.

According to the lawsuit, in the spring of 2021, Bagley Farms Meat Market contacted Ford Hotel Supply Company to purchase equipment and goods. On April 20, 2021, Bagley agreed to purchase equipment from Ford for $150,900, including an outdoor refrigeration system. Bagley claims the refrigeration system was installed by Tawk Mechanical Penguin Services.

Bagley states that since its installation, the refrigeration system has broken down on at least eight separate occasions. Malfunctions allegedly include failing to maintain a set temperature, tripping electronic breakers and completely shutting down. Despite several attempts to repair the refrigeration system, the unit remains defective, the suit states. 

The plaintiff alleges damages for repair costs, lost profits, and harm to its reputation. The lawsuit is seeking a judgement in excess of $50,000, plus attorney fees and any other relief the court deems proper. Bagley is represented by attorney Philip J.
