BELLEVILLE - Heck Trucking is being sued for allegedly failing to pay a former employee for her last week of work and making profits from her stolen licenses.
Christina L. Mesey and AYS Transport, LLC filed a lawsuit in the St. Clair County Circuit Court against Michael Heck, doing business as Heck Trucking, citing unpaid wages and conversion.
According to the lawsuit, Mesey had formed AYS Transport to operate as a trucking company. As part of her business, Mesey and AYC had obtained various necessary licenses, operating permits and stickers from several trucking associations.
Mesey claims she was employed to work for Heck as a trucking dispatcher from October 2019 until May 2021, when she was terminated from her position. Mesey alleges that following her termination, the defendant failed to pay her weekly salary of $1,000 for her final week of employment. She also alleges the defendant took her licenses, operating permits and stickers from her business without permission in order to continue using them to operate his trucking business. According to Mesey, Heck transferred $55,000 in funds to himself and also earned more than $100,000 in profits using her licenses and permits.
Mesey claims the law provides that unpaid wages are entitled to 1 percent in penalties after 15 days. According to the lawsuit, 547 days have passed since the plaintiff demanded her unpaid wages, and that she is entitled to $1,000 at 547% which totals $5,470.
Mesey is seeking damages in the amount of $405,000 for unpaid wages, damages, attorney fees, interest, court costs and any other relief the court deems proper. She is represented in this case by attorney David M. Duree of David M. Duree & Associates, P.C. in O'Fallon.
