Maryville resident claims realtors sold him defective home

EDWARDSVILLE – A Maryville resident claims the realtors who allegedly sold him a defective home concealed a flooding problem.

Plaintiff Mark Jordan filed the lawsuit in the Madison County Circuit Court against Deborah Anne Harshany Trust, Gloria Fields Realty, Inc. and Gloria Fields, citing negligent misrepresentation and fraudulent concealment. 

According to the lawsuit, Jordan entered into a contract to purchase a Maryville home from the defendants on Oct. 5, 2020. The plaintiff states that the defendants presented the home as being in good and usable condition prior to the sale and had completed a residential real property disclosure sheet for the property. Jordan claims that while presenting the home, the defendants deceptively allowed piles of debris to cover a creek that was causing erosion on the property.

Jordan alleges the defendants knew the property was flooding and purposely and fraudulently concealed that fact when making representations of the property during the sale. 

The plaintiff is seeking damages in excess of $50,000, plus punitive damages, court costs, attorney fees and any other relief the court deems proper. He is represented in this case by attorney Thomas G. Maag of Maag Law Firm, LLC in Wood River.
