EDWARDSVILLE – A construction worker is suing his employer after a subfloor collapsed beneath his feet, causing him to fall onto a concrete basement floor.
Plaintiff Benjamin Moynihan filed the lawsuit in the Madison County Circuit Court against defendant Bruce Bullard, citing negligence.
According to the lawsuit, Moynihan was employed by Bullard to construct a building in Alhambra. The plaintiff claims he was on the work site on June 22 when he fell from an improperly erected pre-fabricated subfloor, which was installed by the defendant and his other workers.
Moynihan states that before his fall, the defendant had ordered him to remove the kicker, which holds the I-beam in place while the subfloor was being installed. He claims this caused the I-beam to flip during installation and the subfloor to collapse beneath his feet, dropping him onto a concrete basement floor.
Moynihan claims he has suffered severe and permanent injuries, which have caused him to incur medical expenses and will require the continued services of medical staff to recover. He adds that his injuries have caused him to experience pain and suffering, have caused him to lose wages and will impact his ability to earn income and live a normal life in the future.
The plaintiff is seeking damages in excess of $50,000, plus court costs and any other relief the court deems proper. He is represented in this case by attorney William K. Meehan in University City, Mo.
