EDWARDSVILLE – A teenage driver is being sued for wrongful death after allegedly crashing into a utility pole, killing an 11-year-old girl.
Eric Carlson, acting as independent administrator of the estate of Caylee Hammon, filed a wrongful death lawsuit in the Madison County Circuit Court against defendants Devin Walker and Angela Herrin, citing negligence.
According to the lawsuit, Walker was driving northbound on Veteran's Memorial Parkway in Livingston on Dec. 8, 2020, Hammon, who was 11 years old at the time, was riding as a passenger. The lawsuit states that Walker was under the age of 18 and had a graduated driver's license. The vehicle belonged to Herrin. Walker was allegedly operating the vehicle in an unsafe manner, which caused him to crash into a utility pole. Hammon was seriously injured in the crash and died from her injuries the day after the collision.
According to the lawsuit, Hammon died as a result of Walker's negligence and carelessness. Herrin is named in the lawsuit because she allowed Walker to use her vehicle.
The suit alleges that Hammon's death has caused grief and sorrow to her next of kin. They are seeking damages in excess of $50,000 plus court costs and any other relief the court deems proper.
