EDWARDSVILLE – A woman claims she was wrongfully terminated for seeking worker's compensation benefits after she was injured by a forklift.
Plaintiff Susan Rosser filed the lawsuit in the Madison County Circuit Court against defendant Hirelevel Inc. citing retaliatory discharge in violation of the Illinois Worker's Compensation Act.
According to the lawsuit, Rosser was employed by Hirelevel and contracted to work at GEODIS Logistics, LLC in Granite City on May 13. She claims that while she was at work, she was struck by a forklift and suffered serious injuries to her head, neck and back.
Rosser claims she suffered a temporary disabling condition and filed a worker's compensation claim on May 17. She allegedly she saw her physician, who recommended that she be withheld from work until June 14 because of her injuries. During follow-up visits with her physician, the physician revealed that she wasn't fully healed and couldn't return to full duty until Aug. 9. Rosser states that despite the work restrictions prescribed by her physicians, the defendant repeatedly demanded that she return to work on modified duty against her physicians' orders on May 23 and several times thereafter. Rosser claims she received notice of her termination by the defendant on Aug. 2.
The plaintiff alleges the defendant violated the Illinois Worker's Compensation Act by terminating her in retaliation for her injury and for rightfully claiming workers compensation benefits..
Rosser is seeking damages in excess of $50,000 for lost wages, benefits and mental anguish, plus court costs and any other relief the court deems proper. She is represented in this case by attorney Tonya Genovese of The Gori Law Firm in Edwardsville.
