EDWARDSVILLE – A motorist is suing her insurer for allegedly failing honor her insurance coverage and refusing demands for arbitration.
Plaintiff Gladys Terrell filed the lawsuit in the Madison County Circuit Court against defendant State Farm Mutual Automobile Insurance Company.
According to the lawsuit, Terrell had an insurance policy with State Farm, which provided $25,000 in underinsured coverage. Terrell claims she was involved in a collision on Oct. 31, 2020. Then on Jan. 26, 2022, she settled her claim with other driver's insurance provider, Country Financial, for the policy limit of $25,000 after receiving permission from State Farm to settle.
Terrell states that in April 2022, she started sending demand letters to State Farm regarding the underinsured claim and that she attempted to arbitrate her underinsured claim. She adds that between May 2022 and September 2022, she named an arbitrator and has contacted State Farm repeatedly to demand arbitration. She alleges State Farm made an offer in June, which she rejected. She claims the defendant has since then refused to respond to her demands for arbitration in violation of the underinsured contract.
The plaintiff is seeking relief to cover $60,000 over the state policy limits, attorney fees, court costs and any other relief the court deems proper. She is represented in this case by attorney Christopher M. Donohoo of The Donohoo Law Firm, P.C. in East Alton.
