Property owner claims tenant abandoned property, failed to make payments

EDWARDSVILLE – A Granite City property owner claims the leasing tenant has abandoned the property in breach of their contract. 

Tri-Mor Properties, Inc. filed the lawsuit in the Madison County Circuit Court against Select Management Resources, LLC, citing breach of contact.

According to the lawsuit, on Oct. 1, 1998, the defendant entered into an agreement to lease a property located in Granite City from the plaintiff. The two parties have renewed the five-year lease agreement through 2017, with an option to renew the lease again on Jan. 1, 2018, through Dec. 31, 2022, for a monthly rent payment of $2,925 per month.

As of August 2022, Tri-Mor Properties claims the defendant has allegedly failed to make monthly payments since April 2021. The suit states the defendant has actually abandoned the property in breach of the terms of the lease agreement. 

The plaintiff is seeking damages in the amount of $58,500 for failed rent payments, and repair to the property, plus attorney fees and court costs. Tri-Mor Properties is represented by attorney William W. Schooley in Collinsville.
