Swansea man alleges guest attacked him following argument with his wife

BELLEVILLE – A Swansea resident claims he was injured in a physical alteration at his own home after another man first began arguing with the plaintiff's wife.

Plaintiff Walter Smith filed a lawsuit in the St. Clair County Circuit Court against defendant Rob Folk.

According to the lawsuit, Folk was arguing with Smith's wife when the altercation turned physical on April 21. Smith alleges Folk knocked him to the ground and then "fell on top of plaintiff with his knees in plaintiff's ribs, and with multiple impacts on plaintiff's body, ribs and wrist." Smith claims he suffered injuries including broken ribs and a broken wrist.

The plaintiff claims his injuries have caused him to experience pain, suffering, and mental anguish and will impact his ability to enjoy normal daily activities and earn income. Smith states that as a result of his injuries, he has incurred medical costs and will continue to require medical care to recover from his injuries. 

The plaintiff is seeking damages in excess of $50,000, plus court costs and any other relief the court deems proper. He is represented in this case by attorney Rhonda D. Fiss of The Law Office of Rhonda D. Fiss, P.C. in Belleville.
