Suit alleging woman was video recorded at Godfrey spa voluntarily dismissed

A woman who claims she was video recorded while receiving a facial at a Godfrey spa in 2015 has voluntarily dismissed her complaint.

Plaintiff Colleen Overstreet filed a motion to dismiss on May 3 through attorney Allan Napp of Schrempf Kelly & Napp Ltd. in Alton.

Madison County Circuit Judge Sarah Smith granted Overstreet’s motion on May 4.

“Upon motion of the plaintiff, and for good cause shown, plaintiff allowed to dismiss her complaint, without prejudice. All parties to bear their own costs,” Smith wrote. 

Overstreet filed her complaint on Sept. 8, 2017, against defendants Miroslawa Inc., doing business as Dutch Hollow Medical Day Spa, Miroslawa Figueroa, and Ronald Riddlespringer, doing business as High-Tech Security Systems Inc. 

In her complaint, Overstreet claimed she visited Dutch Hollow Medical Day Spa on Sept. 17, 2015, to receive a facial at its Godfrey facility. Overstreet alleged that without her authorization or knowledge, she was video surveilled or videotaped while dressing and undressing in the room in which she received the spa treatment.

Overstreet alleged the defendants allowed the video surveillance to be viewed or published by unknown parties and failed to protect her personal privacy. 

In an answer to the complaint, Riddlespringer had argued that “at the time of the installation the room in question was the office of Miroslawa Figueroa, and not a treatment room.” 

Overstreet sought a judgment in excess of $50,000, plus court costs.
