Suit alleges Memorial Hospital - Belleville patient died after self-removing 'life-saving treatments'

BELLEVILLE — Memorial Hospital - Belleville and others are being sued after a patient allegedly self-removed "life-saving treatments" and was not intubated quickly enough when she coded. 

Marlena Daab, as special administrator of the estate of Phyllis Deien, deceased, filed a complaint in the St. Clair County Circuit Court against Protestant Memorial Medical Center, doing business as Memorial Hospital -Belleville, Jiggar Hindia, M.D., and others, alleging negligence and other claims. 

Daab alleges in her complaint that on Feb. 11, 2021, the defendants provided medical services to Deien. Daab claims the defendants failed to recognize Deien was at a significant risk for self-removing her high flow oxygen therapy and that she had previously self-removed her urinary catheter and nasogastric tube. 

Daab further claims the defendants failed to have a sitter or other means of preventing Deien from self-removing her life-saving treatments and that the defendants' doctors and nurses failed to intubate Deien immediately during a code. 

Daab alleges the defendants failed to apply the knowledge, skill or care provided by a reasonably well-qualified health care provider, which resulted Deien's death. 

Daab seeks compensation of more than $50,000 and all other just relief. She is represented by Colleen Jones of Cook, Bartholomew, Shevlin, Cook & Jones LLP in Belleville.
