Walmart customer claims employee struck her with stock cart

BELLEVILLE — A Walmart customer claims a store employee struck her with a stock cart and caused her to suffer injuries. 

Kim Burch filed a complaint in the St. Clair County Circuit Court against Preston Stickles and Walmart Inc., alleging premises liability and negligence. 

According to the complaint, Burch was at the Walmart on Great Mount Commons Drive in Belleville on Nov. 5, 2021. She claims that Stickels, a Walmart employee, pushed a stock cart full of products into her and caused her to suffer severe injuries. 

Burch claims the defendants were negligent for failing to manage its premises in a safe condition, allowing the premises to have a dangerous condition and failing to inspect its premises. She also claims Stickles failed to warn her before striking her with the stock cart. 

Burch alleges as a result, she suffered injuries to her neck, back and head as well as soft injuries to her shoulder, muscles, ligaments, tendons and nerves. She also alleges she incurred medical treatment expenses and suffered lost wages. 

Burch seeks compensation of more than $50,000 and all other just relief. She is represented by Thomas Rich, Kristina Cooksey, Michelle Rich, Aaron Chappell and Caitlin Rich of Rich, Rich, Cooksey & Chappell PC in Fairview Heights.
