Suit alleging BIPA violations filed against Doctor John's Inc.

EDWARDSVILLE - A class action filed against Doctor John's alleges the defendant engaged in illegal biometric scanning and information storage practices. 

Plaintiff Timothy Parker filed the lawsuit on March 22 in the Madison County Circuit Court against Doctor John's, Inc., alleging that Dr. John's violated the Illinois Biometric Information Privacy Act (BIPA). 

Parker alleges Doctor John's has allegedly failed to notify potentially hundreds of employees where their biometric data is being kept, how long that information is kept, and what might happen to this data. The lawsuit states that these actions are in violation of BIPA. 

According to the lawsuit, Doctor John's did not obtain consent to collect and store this information. The suit states that the data is is being stored in a manner that is less secure than other sensitive information such as social security numbers.

The plaintiff seeks an order requiring Doctor John's to disclose information in accordance with BIPA and to ensure future compliance. 

He also seeks damages in the amount of $5,000 for each "willful or reckless" violation for each person covered by the class action lawsuit and $1,000 for each "negligent" violation, plus punitive damages, court costs, attorney's fees, interest and any other relief the court deems proper. Parker is represented by attorneys Roberto Luis Costales and William H. Beaumont of Beaumont Costales, LLC. in Chicago.
