71-year-old bicyclist allegedly hit by distracted driver

EDWARDSVILLE - A bicyclist claims a motorist struck him near the Madison County Transit Schoolhouse Trail while driving under the influence and distracted. 

Fred Andres filed a lawsuit in the Madison County Circuit Court against Nathaniel Johnson, alleging personal injury and negligence.

According to the lawsuit, Andres was riding his bicycle near the Madison County Transit Schoolhouse Trail at the intersection of Lake Drive and Horseshoe Lake Road on April 11, 2021, when Johnson allegedly "struck and nearly killed" the plaintiff. The suit states that Johnson was driving while distracted and under the influence when he struck the plaintiff, who was 71 years old at the time. As a result, Andres allegedly suffered traumatic injuries, including multiple fractures, and was hospitalized for several days.

Andres alleges Johnson was negligent in failing to keep a careful lookout, driving while distracted, failing to yield the right of way, operating a vehicle at an excessive speed, driving while intoxicated by drugs or alcohol to the extent that his driving ability was impaired, failing to operate his vehicle in a careful and prudent manner and failing to stop, slow, slack in his speed, sound his horn, swerve or avoid collision with a plaintiff.

Andres claims he was caused to suffer serious injuries to his leg, ankle, neck and ribs. He incurred past and future medical expenses and lost the ability to enjoy life due to impairment, detriment and damages.

Andres seeks a sum in excess of $50,000. Andres is represented by Amanda N. Murphy of Goldblatt + Singer in Clayton, Mo.
