Woman sues State Farm for additional benefits following crash

EDWARDSVILLE - A woman is suing an insurance company for allegedly failing to pay underinsured motorist benefits following a 2018 crash.  

Myranda Reese filed a lawsuit in the Madison County Circuit Court against State Farm Mutual Automobile Insurance Company, alleging breach of contract and vexatious refusal.

According to the lawsuit, Reese was injured in a collision with a third party on Dec. 17, 2018. The crash allegedly resulted in a total of four claimants seeking damages against the third party, who was insured by State Farm Mutual Automobile Insurance Company under an insurance policy with limits of $25,000 per person and $50,000 per incident for bodily injuries caused as a result of the operation of a motor vehicle. 

Reese claims the collision caused her to suffer damages and injuries that exceeded $50,000, including medical bills totaling $11,786.27. The plaintiff claims she settled the underlying third-party case for $10,708 due to the policy limit of $50,000 being split among the four claimants. 

Reese claims her underinsured motorist bodily injury coverage limits are $100,000 per person and $300,000 per incident under the language of the subject policy in which State Farm had issued and was in full force and effective on the date of the collision.

Reese claims she is entitled to additional monetary payment in underinsured motorist benefits. She alleges State Farm is breaching its contract by continually refusing to tinder those benefits to the plaintiff.

Reese seeks a sum in excess of $50,000 plus attorney's fees and costs. She is represented by Timothy P. Hulla of Brown & Brown in St. Louis.
