Manufacturing company allegedly terminated employee over disability

EAST ST. LOUIS - A man claims he was wrongfully terminated from his employment after suffering on-the-job injuries while trying to catch a heavy bucket. 

Christopher M. Tucker filed a federal lawsuit in the U.S. District Court of the Southern District of Illinois against Stellar Manufacturing Company, Stellar Manufacturing Company II, LLC and ADP Totalsource Co. XXII, Inc., alleging violation of ADA and Cut ADAAA and retaliatory discharge.

According to the lawsuit, Tucker was caused to suffer injuries to his neck, shoulders, spine, back and other portions of his body while working as an employee for the defendant when he attempted to catch or stop a heavy, falling bucket on Feb. 1, 2021.  On May 4, 2021, the defendant allegedly terminated the plaintiff from his job on the basis of his disability in violation of the American Disabilities Act of 1990 and the ADA Amendments Act of 2008.

Tucker claims he was caused to suffer wrongful and retaliatory termination, damages, lost wages, income and employment, emotional pain and suffering, humiliation and the loss of a normal life.

Tucker seeks an amount in excess of $50,000, plus court costs. Tucker is represented by Edward J. Szewczvk of Pratt & Tobin PC in East Alton.
