EAST ST. LOUIS - Attorney Benjamin Sweet is suing two more companies on behalf of repeat plaintiff Eric Foreman, alleging they violated the Americans with Disabilities Act.
Forman filed both federal lawsuits in the U.S. District Court for the Southern District of Illinois. He sued Scentair Technologies LLC on Fed. 2 and Ooni Inc. on Feb. 4, alleging violations of Title III of the ADA.
According to the lawsuits, the defendants have digital platforms allowing consumers to research and participate in their services and products from the comfort and convenience of their homes. Foreman claims he attempted to access a digital platform from his home and was unable to due to the defendants' failure to build the digital platform in a manner compatible with screen access programs for accessibility purposes. Foreman was allegedly unable to understand, and was therefore denied the benefit of the content and services he wished to access on the digital platform.
Title III of the ADA guarantees individuals with disabilities to have full and equal enjoyment of products, services, facilities, privileges, advantages or accommodations of any place of public accommodation.
Foreman seeks a judgment citing the defendant for violating Title III of the ADA specific requirements, a permanent injunction directing the defendant to finish to take steps necessary in bringing the digital platform into full compliance, plus court costs and attorney's fees.
