Maag files suit alleging woman violated Gender Violence Act after committing battery

EDWARDSVILLE - A man is suing a woman for allegedly violating the Gender Violence Act after he allegedly suffered years of battery. 

Andrew Smith filed the complaint on Jan. 26 in the Madison County Circuit Court against Arial Smith, alleging violations of the Gender Violence Act. The suit was filed through attorney Thomas Maag of Maag Law Firm in Wood River. 

According to the two-page complaint, Andrew Smith claims that on one or more occasions within the past several years, Arial Smith has committed battery against the plaintiff. Andrew Smith claims the defendant’s actions were motivated by his gender. The complaint does not provide any additional specifics about the situation or the battery. 

As a result of Arial Smith’s alleged actions, Andrew Smith claims he suffered severe and permanent injuries.

He alleges he has incurred medical expenses, lost income, endured pain and suffering and experienced loss of a normal life. 

He seeks damages in excess of $50,000, plus punitive damages, court costs and attorney’s fees.
