Suit alleges Sara Lee All Butter Pound Cake uses soybean oil instead of butter

EDWARDSVILE - A class action suit has been brought against Sara Lee Frozen Bakery for allegedly using soybean oil in its All Butter Pound Cake rather than butter. 

Bobbie Grayer, individually and on behalf of all others similarly situated, filed a class action complaint on Jan. 4 in the Madison County Circuit Court against Sara Lee Frozen Bakery, LLC, alleging violation of the Illinois Consumer Fraud and Deceptive Business Practices Act, unjust enrichment and breach of express warranty.

According to the lawsuit, Sara Lee produces, markets and sells an All Butter Pound Cake that is labeled as being made with all butter and having no artificial flavors or colors from artificial sources. However, Grayer alleges the labeling and phrases used on the packaging are false and deceptive. She claims the ingredients list on the product shows that butter is not used. Instead, she claims soybean oil is used in the ingredients.  

Grayer also alleges that consumers would not have purchased the product had it been known that butter was not used in the making of the product. 

Grayer asks the court to award compensatory damages, declaratory and equitable relief declaring the defendant be enjoined from continuing to engage in deceptive and unfair marketing, pre and post-judgment interest, attorney's fees and court costs.
