Borrower sued by limited liability company over unpaid loan

EDWARDSVILLE - A limited liability company is suing a borrower for allegedly failing to pay back a loan. 

Ascentium Capital LLC filed a lawsuit on Dec. 27 in the Madison County Circuit Court against CFT Performance Incorporated and Joshua Chapman, alleging breach of contract, breach of guaranty, possession of collateral and replevin of collateral.

According to the lawsuit, the defendants made an agreement with Ascentium for the finances to purchase an axel-hub dynamometer kit and equipment for an amount of $51,596.70. The suit states that the defendants have failed to uphold the agreement by failing to pay back funds loaned. 

Ascentium Capital LLC seeks an amount of $51,596.70, plus other contractually applicable charges, pre-and post-judgment interest, recoverable fees, costs and expenses, attorney's fees and costs of suit. Ascentium Capital LLC is represented by Eugene E. Endress of Hahn Loeser & Parks LLP in Chicago.
