EDWARDSVILLE -- A Coca-Cola delivery driver is suing an Alton grocery store, alleging he stepped into a crack in the concrete and suffered injuries.
Louis Viviano filed a lawsuit on Dec. 3 in the Third Judicial Circuit Court of Madison County against Schnuck Markets, Inc. for negligence.
According to the lawsuit, Viviano was at the Alton Schnuck Markets for the purpose of delivering Coca-Cola products to the store on Jan. 3, 2020. He claims he parked his truck in the delivery dock area of the premises, exited the truck and stepped into a large crack and broken concrete. Viviano claims he fell to the pavement, causing him to sustain injuries to his right knee and ankle.
Viviano claims he was caused to suffer permanent and severe injuries, damages for past and future medical expenses and lost wages.
He alleges the defendant failed to warn him about the unsafe concrete, failed to repair the dangerous condition, failed to prevent business invitees from parking their vehicles and walking in the area where he fell, failed to provide a safe means of ingress and egress, and failed to properly inspect the premises.
Viviano seeks a judgment for an amount in excess of $50,000. He is represented by Kenneth K. Vuylsteke of Fox & Vuylsteke LLP in Webster Groves, Mo.
