BELLEVILLE -- A class action alleges the Quaker Oats Company underreports nutrition and overreports numbers of servings for its products.
Heather Erwin filed a class action complaint on Nov. 9 in the St. Clair County Circuit Court against the Quaker Oats Company, alleging violation of the Illinois Consumer Fraud Act, negligent misrepresentation, breach of express warranty and unjust enrichment.
According to the complaint, the Quaker Oats Company manufactures, sells, labels and markets products including Quaker Old Fashioned Oats, Quaker Quick 1 Minute Oats, Quaker Steel Cut Oats, Quaker Steel Cut Oats Quick 3-Minute Oats and Quaker Oats Gluten-Free Quick 1 Minute Oats as having a certain number of servings. The suit states that the containers indicate the number of servings in 1/4, 1/3 or 1/2 intervals for each product and states a specified number of servings or "about" specified number of servings.
Erwin alleges the Quaker Oats Company's labeling of servings in each container is fraudulent and misrepresented as the company "substantially" over-reports the actual number of servings. Therefore, she claims the labeled number of servings are inaccurate, as well as the grams per serving. Furthermore, Quaker underreports the actual caloric and other nutritional information, the suit states.
Erwin seeks injunctive relief that Quaker correctly represents the number of servings and nutritional information. She also seeks compensatory damages, pre and post-judgment interest, attorney's fees and cost of suit. Erwin is represented by David C. Nelson of Nelson and Nelson of Belleville.
